IP Management for Storage in the Operate Stage

Objective

To produce and manage operate stage IP and knowledge, and to finalise IP and Knowledge management processes for the closure stage. 

Major Deliverables

  • Knowledge transfer deliverables for storage for the operate stage.  These may include:
    • Redacted (i.e. with confidential information removed) descriptions of operating procedures used throughout the project
    • Redacted versions of project management deliverables such as programmes, costs, etc
    • Redacted versions of design deliverables for any additions to or upgrades of the injection processes or monitoring, metering and verification (MMV) systems during the operate stage
    • Lessons learnt documents
    • Redacted descriptions of any non-standard injection well operation related to CCS e.g. non-standard frequency of start-up/shut-down
    • Best practice documents based on learning from operate stage e.g. best practice for reacting to variations in CO2 flow rate
    • Summary reports of work completed in operate stage
    • Redacted descriptions of metering, monitoring and verification (MMV) equipment and procedures used throughout the project
    • Redacted results of injection tests
    • Redacted results of tests on novel equipment such as MMV equipment
    • Regular redacted reports on the status of CO2 in the storage site, describing quantity, temperatures, pressures, range within storage complex (2D and 3D) etc
    • Regular redacted forecasts of behaviour of CO2 in the storage site, describing expected dissolution or absorption into substances within storage site, expected reactions with substances or geology in storage complex; expected migration other time, expected changes in temperature and pressure etc
    • Report on actual behaviour of CO2 in storage site and comparison with expected behaviour
    • Incident reports and lessons learnt for any unexpected behaviours plan for ongoing monitoring and handover of storage site to another legal entity
  • IP deliverables for storage for the operate stage, protected by IP management procedures in accordance with agreed IP and knowledge management strategy for the operate stage.  These may include:
    • Descriptions of novel operating procedures for conditioning / injection equipment and wells
    • Novel designs for additions to or upgrades of the conditioning / injection equipment and wells during the operate stage
    • Licenses
    • Patent applications
    • Improvements to design
    • Results of tests performed during operate stage
    • Full versions of design documents and operating procedures
    • Models of storage site including model of CO2 behaviour forecast, geological models etc
  • IP and knowledge management strategy document for closure stage, agreed by financier(s) and supplier(s) describing:
    • Tasks to be undertaken in closure stage relating to IP and knowledge, including knowledge transfer
    • Knowledge deliverables to be produced in closure stage or produced in earlier stages and released in closure stage
    • Extent/map of IP ownership at end of operate phase for injection / conditioning equipment, wells and storage site
    • Descriptions of new or incremental IP / knowledge expected to be produced during closure stage
    • Agreed ownership of new IP/Knowledge, including “black”, “white” and “grey” lists i.e. secret, public, and limited access information
    • Agreed knowledge transfer/knowledge sharing requirements for the define stage and later stages
    • Agreement on who is to implement knowledge transfer/sharing dissemination methods
    • Agreed procedures for quality control and performance management of knowledge transfer processes
    • Any existing knowledge transfer/sharing requirements, rights or obligations with funding parties or other members of the industry
    • Agreed timing of knowledge management activities
    • Any identified implications for project delivery
    • Agreed definitions of major terms e.g. incremental, novel knowledge
  • Knowledge management agreement for closure stage, ready for execution, between financier(s) and each key supplier for the closure stage

Tasks

Specific tasks include the following.

  • Produce operate stage knowledge deliverables for storage.  These may include:
    • Redacted (i.e. with confidential information removed) descriptions of operating procedures used throughout the project
    • Redacted versions of project management deliverables such as programmes, costs, etc
    • Redacted versions of design deliverables for any additions to or upgrades of the injection processes or monitoring, metering and verification (MMV) systems during the operate stage
    • Lessons learnt documents

  • Complete operate stage knowledge transfer / sharing tasks
  • Modify and implement procedures for secure management of IP information produced during operate stage.  This may include:
    • Purchasing and issuing licenses
    • Operating secure rooms and secure data storage for information produced during operate stage
    • Filing patents
    • Executing agreements such as confidentiality agreements
  • Where new IP emerges that is not subject to existing agreement, negotiate and agree on updated IP rights and obligations
  • Regularly review knowledge transfer processes and procedures and adjust to meet changing needs
  • Assess expected new or incremental knowledge to be produced during the closure stage e.g. knowledge developed by decommissioning of first of a kind (FOAK) process etc.  Identify whether these will be developed solely during development of this project or in conjunction with other projects
  • Negotiation between financier(s) and key supplier(s) e.g. capture plant operators / decommissioners to agree on:
    • Ownership of existing IP / knowledge and IP / knowledge expected to be developed during the closure stage
    • Access to IP / knowledge i.e. “black box” /“black list”, “white list” and “grey list” IP
    • Tasks to be undertaken in closure stage relating to IP and knowledge, including knowledge transfer
    • Knowledge deliverables to be produced in closure stage
    • Who will be responsible for knowledge sharing / knowledge transfer / knowledge management in the closure stage
    • Any requirement for escrow
    • Definitions of major terms e.g. incremental, novel knowledge
  • Identify the relevant laws governing IP and any legal requirements for knowledge transfer in closure stage
  • Produce / update agreed IP and knowledge management strategy document, describing:
    • Tasks to be undertaken in closure stage relating to IP and knowledge, including knowledge transfer
    • Knowledge deliverables to be produced in closure stage or produced in earlier stages and released in closure stage
