European Commission Adopts Delegated Regulation and Decision under the NZIA

On 21 May, the Commission adopted a Delegated Regulation under the Net-Zero Industry Act (NZIA).  

The NZIA is a crucial regulation, setting an EU-wide target of 50 Mtpa of CO₂ injection capacity by 2030, which is expected to facilitate the development of permanent geological CO₂ storage across the Union and support Europe’s ambitious decarbonisation objectives. 

The Delegated Regulation under the NZIA clarifies how the European oil and gas producers required to contribute to the NZIA target will be identified, how the individual shares will be calculated and how progress towards achieving the 50 Mt/year CO₂ injection target will need to be reported. 

Following the publication of the delegated regulation, the Commission also adopted on 22 May a Decision listing 44 oil and gas companies identified as obligated producers, alongside their pro-rata contribution to the NZIA target. 

The Delegated Regulation is now under the scrutiny of the European Parliament and Council, which have two months to formulate objections.  

In the absence of objections, the Delegated Regulation is expected to enter into force at the end of July 2025 with the Commission’s Decision, following their publication in the Official Journal of the European Union.
