Australia Advancing Cross-Border Carbon Capture and Storage: Ratification of the 2009 Amendment to the London Protocol

On the 7th of November, Australia declared provisional application of the 2009 amendment to the London Protocol. This marks the achievement of a significant milestone in realising cross-border CCS projects in the region.
This provisional application allows Australia to begin regulating the cross-border transport of CO₂ for offshore sequestration in geological formations and enter into bilateral agreements for this activity while awaiting the 2009 amendment to enter into force internationally.
Over the past 12 months, the Australian government has taken several steps to establish a transboundary CCS value chain, including:
- The passing of the Environment Protection (Sea Dumping) Amendment (Using New Technologies to Fight Climate Change) Act 2023
- Ratifying the 2009 amendment to the London Protocol on the export of CO2 for offshore sequestration
- The development of the Interim National Action List for Offshore Carbon Dioxide Sequestration
- The provision in the 2024-25 Federal Budget of $32.6 million over four years for regional cooperation on carbon sequestration, to support the establishment of regulatory frameworks and bilateral instruments.
