On January 17th, the U.S. Environmental Protection Agency (EPA) granted West Virginia primary enforcement authority (primacy) to issue permits for Class VI wells that are used to inject CO₂ into deep underground rock formations for permanent storage. Primacy allows states to issue permits for Class VI wells instead of the EPA to streamline permitting using unique state-level expertise, while the EPA maintains regulatory oversight. Class VI wells are critical infrastructure for CCS projects. 

West Virginia is the fourth state to receive Class VI primacy following North Dakota, Wyoming, and Louisiana.
